FORECLOSURE DEFENSE

You may be surprised to learn that you may sue your Bank for Unfair Lending Practices.  As a result, your mortgage debt may be substantially reduced or your Short Sale facilitated.  Actions against Banks for Negligence, Misrepresentation, Breach of Fiduciary Duty and other have been successful.  It has been found that certain mortgages issued during the last few years have been deceptive such as negative amortization or Option loans.  A review of your mortgage, note and facts will be necessary to determine your Bank’s liability.

MORTGAGE MODIFICATION AND REFINANCE

Many homeowners have found government programs and Banks voluntarily helping to modify mortgage debt.  There must be a Hardship.  Also, your income and expense budget will be reviewed to determine your ability to pay the modified payment.  If you do not fall within the guidelines, your mortgage will not be modified.

Furthermore, if you do fall behind on your payments and cannot modify or refinance, foreclosure action will be pursued by the Bank.  If you want to stay and keep your house, your only alternative may be instituting suit against the Bank if liability exists.  Other wise, you should pursue a Short Sale.
SHORT SALES

Short Sale is selling your property for an amount less than what is owed.  In order to accomplish this, you must obtain the Bank’s approval.  While the house is being sold, you may remain in the home even though you are not paying the mortgage. A short sale releases you by the Bank so they can never sue you for the amount still owed.

TRUSTS AND PROBATE

The preparation of Revocable Trusts and the transfer of assets during lifetime eliminates the need to spend money and time probating your Last Will and Testament.
